Curated Zen Client Terms and Conditions
These Terms and Conditions apply to services purchased from Curated Zen. They should be read with the applicable service description, booking information and any written proposal issued for a tailored engagement. By making payment, confirming a booking, ticking an electronic acceptance box or otherwise confirming in writing, the Client accepts these Terms and the scope of the selected service.
1. Nature of Service
Curated Zen provides design consultancy, design guidance and curation services. Advice is based on the information supplied by the Client and the professional design judgement of Curated Zen. Curated Zen is not engaged as a contractor, executor, site supervisor, project manager, structural or services engineer, quantity surveyor, manufacturer, retailer or warranty provider unless a separate written agreement expressly states otherwise.
Curated Zen does not undertake procurement, accept commissions or receive kickbacks in relation to products, vendors, contractors or services recommended to a Client.
2. Scope of Service and Additional Work
Only the deliverables expressly stated for the service purchased or, for Zen Signature, the written proposal accepted by the Client are included. Curated Zen may determine before or after review of the submitted information that a request falls outside the selected service or is better handled through another service or a tailored engagement.
Work outside the agreed scope, including additional rooms or questions, changed requirements, new alternatives, redesign, further consultations, technical drawings, detailed documentation, procurement, contractor coordination, site supervision or site visits, requires a separate booking or written proposal and additional fee unless expressly included.
3. Payment and Commencement
The full applicable fee for Curated Zen Refresh, Zen Curation Session and Zen Companion is payable in advance. For Zen Signature, payment terms will be stated in the applicable written proposal. Work normally begins only after Curated Zen has received the required payment, the Client has accepted the relevant Terms and scope, and Curated Zen has received the information reasonably required to begin.
Any stated turnaround period begins only once all of these requirements have been met. Curated Zen may pause work where information is incomplete, conflicting instructions have been received or a required decision has not been provided.
4. Cancellation Rescheduling and Refunds
Fees paid for Curated Zen Refresh, Zen Curation Session and Zen Companion are non-refundable once payment is made, subject to the limited arrangements below and to any consumer right that cannot lawfully be excluded.
A Zen Curation Session or an individual Zen Companion session may be rescheduled once, subject to availability, where the Client gives at least 24 hours’ notice. A late cancellation, a missed session or a request for a further rescheduling will be treated as a used session.
For Curated Zen Refresh, where the Client cannot proceed before submitting project information and before Curated Zen has commenced analysis, the amount paid may be retained as a credit toward the same service for 30 days. No cash refund will be issued in that circumstance.
Zen Signature cancellation, rescheduling and refund arrangements will be governed by the applicable written proposal. If Curated Zen is unable to provide a confirmed service, Curated Zen will offer an alternative date or an appropriate refund for the undelivered portion of that service.
5. Client Information and Authorised Contact
The Client must provide complete and accurate plans, dimensions, photographs, videos, budgets, preferences, constraints, references and other information reasonably requested. Recommendations may rely on this material.
The Client must nominate one authorised contact for the project. Curated Zen may rely on that person’s instructions, approvals and communications. If conflicting directions are received from multiple persons, Curated Zen may pause work until the Client provides a single written direction through the authorised contact.
6. Site Verification and Specialist Advice
Before purchase, fabrication or execution, the Client must verify site dimensions, technical requirements, product specifications, prices, availability and suitability with the relevant supplier, contractor or qualified professional. Any recommendation involving structural work, electrical systems, plumbing, waterproofing, fire or life-safety matters, building services or other specialist technical issues must be verified by an appropriately qualified professional before execution.
7. AI Visualisations and Reference Material
Any AI-generated image, mood image, reference image or visualisation supplied by Curated Zen is a conceptual aid only. It is not an architectural, engineering, fabrication or construction drawing and may contain visual inaccuracies, substitutions or differences from products and materials actually available. It must not be used as the sole basis for purchase, fabrication or execution.
8. Budgets Prices and Product References
Any budget range, cost indication, product price or expenditure estimate supplied by Curated Zen is guidance based on information reasonably available at the time. It is not a quotation or guarantee of final project cost. Prices, taxes, delivery charges, availability and vendor terms may change. The Client should obtain and verify current quotations before committing to a purchase or execution.
9. Revisions and Clarifications
Each service includes only the revisions or clarifications expressly stated in its service scope. A clarification is intended to resolve a misunderstanding of the delivered recommendation. It does not include a new design direction, new alternatives, changed requirements, repeated reworking or a redesign. Additional work may be quoted separately.
10. Third Party Products and Execution
Product, material, vendor or contractor references are recommendations or references only. Curated Zen does not control third-party pricing, stock, workmanship, delivery, warranties, installation or performance and is not responsible for changes or failures relating to third-party goods or services. Final purchase and execution decisions remain with the Client and the relevant executing professionals.
11. Responsibility and Liability
Curated Zen will provide the contracted consultancy service with reasonable professional care. To the extent permitted by law, Curated Zen is not responsible for loss or damage arising from inaccurate or incomplete Client information, undisclosed or unverified site conditions, third-party products or services, execution contrary to the recommendation, market or availability changes, specialist matters requiring separate professional verification, or matters outside the agreed scope.
12. Intellectual Property and Client Use
Curated Zen retains ownership of its pre-existing templates, methods, systems and original consultancy materials. Unless otherwise agreed in writing, the Client receives a non-exclusive right to use the project-specific material supplied for their own identified project. It may not be commercially resold, reproduced as a service or represented as the Client’s own professional design work.
13. Privacy Confidentiality and Publicity
Client information will be used for providing and administering the service. Curated Zen will not publish identifiable Client photographs, videos, plans, testimonials or project material for marketing or social media without the Client’s permission. Any request to tag Curated Zen, provide a testimonial or permit a project feature, Reel or other public use is optional and separate from the purchase of a service.
14. Zen Signature and Other Tailored Engagements
All variations of Zen Signature and other tailored, full-project or custom consultancy engagements will be governed by a separate written scope and fee proposal and, where appropriate, project-specific terms. A Zen Signature proposal may include a site visit where appropriate in Noida,Ghaziabad or Delhi only if that visit is expressly stated. In the event of a conflict, the project-specific written agreement will apply to that engagement to the extent stated in it.
15. Disputes and Governing Law
The parties should first attempt in good faith to resolve any concern mutually. Subject to applicable law and any mandatory consumer rights, these Terms and conditions are intended to be governed by Indian law, with courts of competent jurisdiction in Noida or Ghaziabad having jurisdiction where legally permissible.
